Parental Notification/ Judicial Bypass
Under Florida law, almost all girls under age 18 must notify a parent or legal guardian that she is going to have an abortion.
All women under age 25 must take proof of age with them to the clinic.
Because of the way the law is written, most clinics require that the parent or guardian go beyond the requirements of the law and accompany the under age 18 minor to the clinic. All parents/guardians must bring documentation proving their relationship to the girl.
Exempted from the Parental Notification requirements are the so-called emancipated minors, which are defined as those minors who have already birthed and are parenting a child, who are married, or who have been previously emancipated by the court.
Minors that are unable to notify at least one of her parents or her legal guardian must go to the courthouse and obtained a waiver called judicial bypass before having an abortion.
The requirement of getting a Judicial Bypass applies to: all minors under 18 wgo can not ask one of her parents/guardian to accompany her during her visit to the abortion clinic; all minors in foster care; and all minors living with an unofficial guardian – i.e., the guardian does not have court papers naming her legal guardian – must also obtain judicial bypass.
